Dinner’s On Us promotion

1. The promotional period starts on 9 June 2021 at 9:00 am ACST and ends on Monday 21 June 2021 at 9:00 am ACST Adelaide time (promotional period).
2. The promoter is Adelaide Economic Development Agency (AEDA) (ABN 76 182 348 392), a subsidiary of the Corporation of the City of Adelaide (Council).

3. ENTRANTS
3.1 The promotion is open to South Australian residents aged 18 years or over.
3.2 Entry is free.
3.3 To enter this promotion, entrants must complete the form at experienceadelaide.com.au during the promotional period.
3.4 Entrants will go into the running to win one of 5,000 prize vouchers.
3.5 Entrants must provide an active email address. Any person who provides an email address which is non-existent or is otherwise an email address to which AEDA’s email system is unable to deliver an email containing a prize voucher on the first attempt (regardless of whether this inability is due to AEDA’s email system, the person’s email system, or any other reason) is disqualified from the promotion and is not considered to be an entrant.
3.6 Email addresses must correspond to one entrant only. If multiple persons submit the same email address to AEDA for the purposes of entering the promotion, all such persons are disqualified from the promotion and are not considered to be entrants.
3.7 Entrants may only submit one entry in the promotion over the course of the promotional period. Where AEDA reasonably forms the view that a person has submitted more than one entry over the course of the promotional period, that person is disqualified from the promotion and is not considered to be an entrant.
3.8 Council and AEDA officers and employees, and spouses, partners, parents (including parents-in-law) children (including step-children) of Council and AEDA officers and employees, are ineligible to enter the promotion.
3.9 Each entry will have equal chance at winning a prize.
3.10 Each entrant agrees, by virtue of entering the promotion, to have their details recorded to receive further promotional emails from AEDA (entrants may unsubscribe from these emails at any time).
3.11 Persons who are ineligible for or disqualified from the promotion in accordance with these terms and conditions will not be notified of their ineligibility or disqualification.
3.12 If 5,000 or fewer email addresses (excluding email addresses which are duplicated or which otherwise correspond to persons whom AEDA is aware are ineligible or disqualified) are received during the promotional period, a prize voucher will be emailed to all of those email addresses by 5:00 pm ACST on 25 June 2021 (or such later time as AEDA may reasonably determine) and the following procedure will apply in order to distribute the remainder of the 5,000 vouchers (including any vouchers which could not be delivered by email):
3.12.1 If the number of email address referred to in clause 3.12 (but now also excluding any email addresses to which a prize voucher could not be delivered) is greater than the number of remaining vouchers, a number of email addresses which is the same as the number of remaining vouchers will be drawn at random using a random electronic drawing process on 28 June 2021 at 11:30 am ACST. A voucher will then be emailed to each selected email address.
3.12.2 If the number of email address referred to in clause 3.12 (but now also excluding any email addresses to which a prize voucher could not be delivered) is the same as the number of remaining vouchers, all email addresses will be emailed another voucher.
3.12.3 If the number of email address referred to in clause 3.12 (but now also excluding any email addresses to which a prize voucher could not be delivered) is less than the number of remaining vouchers, all email addresses will be emailed another voucher as many times as is necessary until there are fewer vouchers than email addresses (at which time a draw will be conducted in accordance with clause 3.12.1).
3.12.4 If an entrant will be emailed multiple additional vouchers in accordance with the operation of this clause, these vouchers may all be emailed together after any draw conducted in accordance with this clause.
3.12.5 An independent scrutineer will be present at the time, and for the duration, of any draw under this clause.
3.12.6 AEDA may, following consultation with the independent scrutineer, alter the times of any draw under this clause for any reason.
3.12.7 Any draw under this clause will take place at the City of Adelaide Customer Centre located at 25 Pirie Street, Adelaide SA 5000.
3.12.8 The additional vouchers distributed under this clause will be emailed to recipients by 5:00 pm ACST on 30 June 2021 (or such later time as AEDA may reasonably determine).
3.13 If more than 5,000 email addresses (excluding email addresses which are duplicated or which otherwise correspond to persons whom AEDA is aware are ineligible or disqualified) are received during the promotional period, a Primary Draw and, if necessary, Supplementary Draws, will take place in accordance with the below provisions.
3.14 If for any reason (including technical difficulty or error) a prize voucher is delivered to a person who is ineligible for or disqualified from the promotion (such as because they are not a South Australian resident), AEDA reserves the right to cancel such prize voucher without notice.
3.15 Nothing in these terms and conditions will be construed as obliging AEDA to distribute more than 5,000 prize vouchers, and AEDA is not obliged to redistribute prize vouchers which were provided to ineligible or disqualified persons (whether or not those vouchers are cancelled).

4 THE PRIMARY DRAW
4.1 Five thousand (5,000) email addresses will be selected from the email addresses provided during the promotional period (excluding email addresses which are duplicated or which otherwise correspond to persons whom AEDA is aware are ineligible or disqualified) at random using a random electronic drawing process on 22 June 2021 at 11:30 am ACDT (Primary Draw). The Primary Draw will take place at the City of Adelaide Customer Centre located at 25 Pirie Street, Adelaide SA 5000.
4.2 Entrants will be able to attend the drawing of the email addresses but presence is not necessary to win a prize.
4.3 An independent scrutineer will be present at the time, and for the duration, of the Primary Draw.
4.4 AEDA may, following consultation with the independent scrutineer, alter the time of the Primary Draw for any reason.
4.5 Prize vouchers will be emailed to each of the 5,000 email addresses by 5:00 pm ACST on 25 June 2021 (or such later time as AEDA may reasonably determine).
4.6 A list of the winning email addresses will be displayed at the City of Adelaide Customer Centre at 25 Pirie Street, Adelaide SA 5000 for a period of seven (7) days following the Primary Draw.

5 SUPPLEMENTARY DRAWS

5.1 If AEDA receives one or more notifications that a prize voucher sent pursuant to clause 4.5 cannot be delivered to an email address, supplementary draws will occur in accordance with the below provisions and consistent with the below example to ensure that all 5,000 prize vouchers are delivered to unique entrants.
5.1.1 Example—
5.1.1.1 If, following the sending of prize vouchers pursuant to clause 4.5, AEDA receives 150 notifications that an email containing a prize voucher cannot be delivered to an email address, a first supplementary draw will occur (excluding winners from the Primary Draw) to draw the winners of the 150 vouchers which have not been delivered to any entrant.
5.1.1.2 If, following the sending of prize vouchers after the first supplementary draw, AEDA receives 10 notifications that an email containing a prize voucher cannot be delivered to an email address, a second supplementary draw will occur (excluding winners from the Primary Draw and the first supplementary draw) to draw the winners of the 10 vouchers which have not been delivered to any entrant.
5.1.1.3 If, following the sending of prize vouchers after the second supplementary draw, AEDA receives 1 notification that an email containing a prize voucher cannot be delivered to an email address, a third supplementary draw will occur (excluding winners from the Primary Draw and the first and second supplementary draws) to draw the winner of the 1 voucher which has not been delivered to any entrant.
5.1.2 To avoid doubt—
5.1.2.1 When AEDA receives a notification that an email containing a prize voucher cannot be delivered to an email address, the person who provided that email address is not a prize winner, as they are not an entrant in the promotion whatsoever (in accordance with the operation of clause 3.5). No attempts will be made to contact any such person.
5.1.2.2 An ‘out of office’ email or other similar automatic reply generated upon delivery of an email containing a prize voucher to an email address does not constitute notification that the email containing the prize voucher cannot be delivered to the email address. The email will be deemed to have been delivered and the prize voucher will be deemed to have been claimed.
5.2 The first supplementary draw (if required) will be drawn on 28 June 2021 at 11:30 am ACST. Emails containing prize vouchers will then be emailed to each of the email addresses drawn in the first supplementary draw, as soon as practicable.
5.3 The second supplementary draw (if required) will be drawn on 29 June 2021 at 11:30 am ACST. Emails containing prize vouchers will then be emailed to each of the email addresses drawn in the second supplementary draw, as soon as practicable.
5.4 The third supplementary draw (if required) will be drawn on 30 June 2021 at 11:30 am ACST. Emails containing prize vouchers will then be emailed to each of the email addresses drawn in the third supplementary draw, as soon as practicable.
5.5 Further supplementary draws (if required) will occur every 24 hours in accordance with the pattern set out in clauses 5.2 to 5.4, until all 5,000 prize vouchers are delivered to entrants.
5.6 The supplementary draws (if required) will each take place at the City of Adelaide Customer Centre located at 25 Pirie Street, Adelaide SA 5000.
5.7 The email addresses drawn in any supplementary draws will be selected using a random electronic drawing process which is the same or substantially the same as the random electronic drawing process used in the Primary Draw.
5.8 An independent scrutineer will be present at the time, and for the duration, of any supplementary draws.
5.9 AEDA may, following consultation with the independent scrutineer, alter the times of any supplementary draws for any reason.

6. THE PRIZE

6.1 The total prize pool is valued at one hundred and fifty thousand dollars ($150,000) and comprises 5,000 x $30 dinner vouchers which can be redeemed at participating businesses.
6.2 Prize vouchers will be emailed to successful entrants in the format of a QR code. Vouchers can only be redeemed by the scanning of the QR code by a participating business at the time of dining. To avoid doubt, mere presentation of any email (including any reminder email) will not constitute redemption of the voucher and does not entitle the recipient to claim any discount if the QR code is not scanned at the time of dining.
6.3 The prize vouchers can be redeemed at participating businesses within the City of Adelaide (including North Adelaide) in accordance with these terms and conditions.
6.4 A list of participating businesses will be available at experienceadelaide.com.au. The list of participating businesses may change at any time and businesses may opt to have exclusion days or periods when vouchers may not be redeemed.
6.5 Vouchers can be redeemed 1 July to 31 August 2021 (inclusive).
6.6 Vouchers are not redeemable for cash.
6.7 Vouchers are valid for one use only and cannot be reused.
6.8 Vouchers are transferable and accordingly can be used any person including persons who were not the original recipient of the prize voucher email. However, to avoid doubt, a voucher is valid for one use only regardless of who uses it.
6.9 Vouchers can only be redeemed during dinner time trading periods, as designated by the participating business. Vouchers can be redeemed for eat-in food only, up to the value of $30. Vouchers are not valid for takeaway, alcohol or other beverages.
6.10 If the value of food is less than $30, any residual value is forfeited and the voucher is voided for further use. No compensation will be payable if a person is unable to use any element of the prize as stated for whatever reason. Any part of the prize that is not taken for any reason is forfeited.

7. Any decision of AEDA in relation to any aspect of this promotion, including interpretation of any aspect of these terms and conditions, is final and no further correspondence will be entered into by AEDA with any entrant regarding the result (unless directed by any regulatory authority).
8. This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. As an entrant, you completely release Facebook.
9. AEDA makes no representation, expressly or implied, as to the quality, reliability or suitability of the prizes and expressly disclaims any liability. Any problems associated with the prizes should be brought to the attention of the relevant participating business.
10. Your Personal Information is being collected by the Promoter to determine your eligibility to be an entrant in the promotion, to award prizes (where appropriate), and to provide marketing information. If you fail to provide the Personal Information that is being requested you may not be able to enter this promotion, receive a prize, have us deal with your complaint or receive marketing information (as applicable). The Privacy Policy of the Council explains how you may seek correction to Personal Information the Promoter holds and how to make a complaint and is available at cityofadelaide.com.au/privacy.
11. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated for any reason, including but not limited to technical difficulties, unauthorised intervention or fraud, AEDA reserves the right in its sole discretion and to the extent permitted by law, to: (a) disqualify any entrant; or (b) modify, suspend, terminate or cancel the promotion, as appropriate and subject to any relevant approval or directions from a regulatory authority.
12. AEDA accepts no responsibility for any entries not received for any reason during the promotional period. Entries will be deemed to be accepted at the time of receipt by AEDA and not at the time of transmission. No responsibility will be taken for lost, late or misdirected entries. AEDA is not responsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times.
13. The laws of South Australia apply to this promotion. Entrants submit to the exclusive jurisdiction of the courts of South Australia.
